Buffalo Games LLC & Subsidiaries including, but not limited to EastPoint Sports Ltd. LLC and CEACO Inc ("Buffalo Games," "we," "our," or "us") is committed to protecting your privacy and ensuring that our data handling practices are transparent, secure, and compliant with applicable privacy laws. This Privacy Policy explains how we collect, use, maintain, protect, and handle personal information in connection with our mobile applications, including but not limited to Tattoo Maker and other companion apps (each, an "App"), and any associated IoT physical products (collectively, the "Services").

This policy DOES NOT apply to information that:

  • We collect offline or on any other Buffalo Games apps or websites, including websites you may access through this App.
  • You provide to or is collected by any third party, including other apps, websites, or content that may link to or be accessible from or through this App.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, create an account, or use this App. By downloading, creating an account, or using this App, you agree to this privacy policy. This policy may change from time to time (see Updates to this Privacy Policy). Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

We recommend that parents or guardians review this policy with their children and encourage discussions around responsible digital behavior.

  1. Children’s Privacy

The Children's Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform parents and legal guardians (as used in this policy, "parents") about our practices for collecting, using, and disclosing personal information from children under the age of 13 ("children"). It also requires us to obtain verifiable consent from a child's parent for certain collection, use, and disclosure of the child's personal information.

Our Services are designed to be used by children under the age of 13 only with verifiable parental or legal guardian consent. We comply with the COPPA and do not knowingly collect, use, or disclose personal information from children without such consent.

At this time, we do not collect, store, or share any personal information from users, including children. This includes any identifiers, account data, or metadata associated with usage. If in the future we introduce features that involve data collection (such as cloud functionality or online profiles), we will implement robust mechanisms to ensure full COPPA compliance, including prominent parental notices, consent forms, and age gates.

If you are a parent or legal guardian and believe your child has submitted personal information without your consent, please contact us immediately at [email protected]. We will act promptly to delete the information and prevent further unauthorized collection.

 

  1. Information We Do Not Collect

Currently, the App does not collect any personal or device-related information. Specifically, we do not collect:

  • Names, email addresses, phone numbers
  • GPS or coarse location data
  • Photos, audio, or video recordings stored on the device
  • User-generated analytics, interaction logs, or behavioral metrics
  • Advertising identifiers, cookies, or tracking pixels.

All interactions with the App are self-contained on the user’s device. This reduces the risk of unauthorized data access, exposure through third-party APIs, or accidental disclosure through misconfigured services.

 

  1. User-Generated Content (UGC)

The App allows users to upload or create content such as personalized images or photos. This content is stored locally on the user's device and is not transmitted to Buffalo Games. We do not access, review, or moderate UGC unless a future version includes cloud-sharing or online storage features.

If in the future users under 13 are able to share content externally through our systems, we will implement verified parental consent protocols and clearly disclose the scope and risks involved in such sharing. We will also incorporate options for content review, deletion, and withdrawal of consent.

 

  1. Future Features and Changes

Should we introduce features that require the collection or transmission of user data, we will:

  • Update this Privacy Policy with transparent, plain-language descriptions of all data practices
  • Notify users via in-app pop-ups or onboarding flows of material changes
  • Seek affirmative opt-in consent for any sensitive data collection
  • Implement granular permission controls to limit data collection to what is strictly necessary

Our aim is to design features with privacy-by-default and to follow industry standards such as data minimization and purpose limitation.

 

  1. Third-Party Services

Our App does not currently rely on or integrate with any external SDKs, advertising networks, analytics services, or cloud infrastructure. This means that no user data is passed to third parties directly or indirectly.

If future versions of the App include such integrations, we will:

  • Conduct privacy risk assessments of each third-party provider
  • Enter into binding data processing agreements (DPAs) where applicable
  • Disclose the identity and role of each third party in this Privacy Policy
  • Provide opt-out controls and transparency around data flows.

 

  1. Data Security

Although we do not collect personal data at this time, we take data security seriously. We have implemented design-level precautions including:

  • Limiting App permissions to only what is functionally required
  • Ensuring offline operation to avoid external attack surfaces
  • Hardening code and configurations to prevent reverse engineering or data leakage

Should future updates involve backend storage or communication with external servers, we will implement encryption in transit and at rest, access control measures, secure audit logs, and regular security reviews.

However, unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the App.

  1. International Users

Our Services may be accessed and used by individuals located in the United States, Canada, and countries within the European Economic Area (EEA). While we currently do not collect personal information, should this change in the future, we will ensure compliance with applicable data protection laws, including but not limited to:

  • The General Data Protection Regulation (GDPR) for EEA users
  • The Personal Information Protection and Electronic Documents Act (PIPEDA) for Canadian users
  • Applicable provincial or national child privacy protections

We will ensure appropriate safeguards are in place for international data transfers, including Standard Contractual Clauses (SCCs) and Data Protection Impact Assessments (DPIAs), as required by law.
